¶14 But even assuming the State dismissed the charges, “the function of a probation violation hearing is not to decide guilt or innocence but to determine, by a preponderance of all reliable evidence, whether a probationer has violated the terms and conditions of his probation.” (affirming probation revocation even after the State dismissed charges).
