¶15 The constitutions of both the United States and Arizona clearly give the defendant in a criminal case the right to trial by jury; but “[i]t is well established that the right to a jury trial may be waived when the accused is aware of this right and voluntarily and intelligently relinquishes it.” (citing Patton v.
