We have held that the comparative negligence statute is constitutional under the provisions of article XVIII, § 5 of our constitution, which declares that contributory negligence “shall, in all cases whatsoever, be a question of fact and shall, at all times, be left to the jury.” See Hall v. A.N.R Freight Sys., Inc., P.2d 434 (1986).
